PRIVACY STATEMENT OF WÜRTH BELUX NV

First of all, we are pleased that you are interested in the goods/services of WÜRTH BELUX.

In this privacy statement, we inform you about how Personal Data that you provide to us through various channels, including our Website and third-party social media channels, are processed by us.

We may ask you to share certain Personal Data with us, including but not limited to your first name, last name and email address (identification data). For certain specific obligations, you may need to provide us with additional data, such as payment and billing details.

We only collect the Personal Data necessary to inform you about our goods/services, to contact you, to perform an agreement with you, to pursue our legitimate interest and to comply with a legal obligation to which we are subject.

For this purpose, we rely on the legal bases of performance of the agreement, legal obligation, our legitimate interest and, in some cases, your consent (see also Article 3).

Definitions

“Personal Data” has the meaning as defined in the General Data Protection Regulation 2016/679, including any information by which a natural person (also referred to as the “data subject”) is identified or can be identified.

“Controller” has the meaning as defined in the General Data Protection Regulation 2016/679. Adolf Würth GmbH & Co. KG shall be qualified as the controller determining the purposes and means of the processing of your Personal Data.

“Processor” has the meaning as defined in the General Data Protection Regulation 2016/679, namely a party that processes Personal Data on behalf of / under the instruction of the Controller.

“Website” means the WÜRTH BELUX website: www.wurth.be, which is technically managed by Adolf Würth GmbH & Co. KG, 74653 Künzelsau-Gaisbach, Reinhold-Würth-Straße 12–17 (Germany) and registered under company number DE 146 280 061.

“WÜRTH BELUX” means WÜRTH BELUX NV, a company under Belgian law, with registered office at 2300 Turnhout (Belgium), Everdongenlaan 29 and registered with the Crossroads Bank for Enterprises under number 0435.180.897.

Types of Personal Data

In the context of our services, we collect and process various categories of Personal Data, including identity and contact details and financial data. These Personal Data may relate to you in your capacity as a customer, supplier and client, and to their staff and employees. However, it is not possible to provide a concrete list of all Personal Data processed by us. The following list of Personal Data is therefore purely illustrative and non-exhaustive.

  • Company number or VAT number
  • Telephone number
  • Email address
  • Interaction data
  • IP address insofar as we can identify you on that basis
  • Purchase history insofar as we can identify you on that basis
  • Other Personal Data that you provide to us or that we have received through third parties in the context of performing our assignment

Sensitive Personal Data:

  • Financial data such as your bank account number where necessary

Customers

In order to comply with the obligations imposed on the Controller in the context of legal and administrative obligations and to comply with the provisions of the Civil Code and accounting legislation, we process certain data such as identity and contact details and financial data of our customers and clients, their staff and employees in the context of our services.

Suppliers and subcontractors

In order to comply with the obligations imposed on the Controller in the context of legal and administrative obligations and to comply with the provisions of the Civil Code and accounting legislation, we process identity and contact details and financial data of our suppliers and subcontractors, as well as any of their (sub)subcontractor(s), their staff and employees in the context of our services.

Staff

In order to comply with the obligations imposed on the Controller in the context of legal and administrative obligations and to comply with the provisions of and accounting legislation, we process identity and contact details and financial data of our staff in the context of our personnel administration and payroll administration.

Necessary for the performance of the agreement

Customers

In the context of our services, we collect and process the identity and contact details of our customers and clients, their staff and employees that are necessary for the performance of the agreement, the provision of our services and customer assignment data, customer management and accounting, but also in the pre-contractual phase such as contacting, negotiating, providing/requesting information in the context of preparing and concluding an agreement.

Suppliers and subcontractors

We collect and process the identity and contact details of our suppliers and subcontractors, as well as any of their (sub)subcontractor(s), their staff and employees for purposes such as performance of the agreement, management of suppliers/subcontractors and accounting, but also in the pre-contractual phase such as contacting, negotiating, providing/requesting information in the context of preparing and concluding an agreement.

Staff

We process Personal Data of our staff that are necessary for the performance of the agreement in the context of our personnel administration and payroll administration, such as identity and contact details and financial data.

Applicants

We process the identity and contact details as well as the employment history and other data that are commonly included in a curriculum vitae (such as a photo) of applicants when they provide us with this information. The Personal Data are processed to assess whether they qualify for a job with us. The processing of these data is necessary for the performance of an agreement.

Legitimate interest

Customers

In the context of our services, we collect and process the identity and contact details of our customers and clients, their staff and employees on the basis of our legitimate interest for direct marketing activities such as sending promotional or commercial information.

Suppliers and subcontractors

We collect and process the identity and contact details of our suppliers and subcontractors, as well as any of their (sub)subcontractor(s), their staff and employees on the basis of our legitimate interest to ensure the proper functioning of our activities.

Staff

We process the Personal Data of our employees in the context of our personnel administration and payroll administration on the basis of our legitimate interest.

Consent

Customers

In the context of our services, we collect and process the identity and contact details of our customers and clients, their staff and employees on the basis of your consent for the use of cookies, the use of photos on our Website and social media pages, the use of testimonials on our Website and direct marketing activities such as sending promotional or commercial information.

Staff

We process the Personal Data of our staff, such as photos used for commercial purposes or posted on our Website, on the basis of their consent.

Applicants

If we wish to retain Personal Data in the context of an application for longer than one month after the end of the application procedure, we will ask for your consent. From that moment on, we process these Personal Data on the basis of your consent.

Other data

In addition to the data of customers, suppliers/subcontractors, staff and applicants, we also process Personal Data of others, such as potential new customers/prospects, useful contacts within our sector, network contacts, etc. This takes place through our Website or through other channels. The purposes of these processing activities are in the interest of our activities, direct marketing and public relations. The legal basis is our legitimate interest, the performance of an agreement and, in some cases, your consent.

More specifically, we may use the Personal Data we collect for the following purposes:

  • to provide you with our goods/services and perform any agreements;
  • to process and handle possible complaints or requests;
  • to process your application;
  • to help us evaluate, correct or improve the Website and all related services of WÜRTH BELUX;
  • for direct marketing purposes;
  • for internal reasons, including business administration and archiving purposes.

The confidentiality of your Personal Data

Whenever you provide Personal Data to us, we will treat this information in accordance with the provisions of this privacy statement and the legal obligations regarding the processing of Personal Data, including the General Data Protection Regulation (GDPR) 2016/679.

We implement appropriate measures and procedures to secure and protect the Personal Data that we collect through the Website or via electronic correspondence. In this way, we undertake, insofar as can reasonably be expected, to prevent unlawful processing of Personal Data and accidental loss or destruction of your Personal Data. Despite these precautions, however, we cannot guarantee that your Personal Data will be protected if such data are transmitted outside the contact form on the Website in an unsecured manner through other channels or otherwise communicated.

We strive to optimise the security of your Personal Data by limiting access to your Personal Data to persons on a “need-to-know” basis (for example: only WÜRTH BELUX and its employees, staff members or subcontractors who need your Personal Data for the purposes described in Article 3 will have access to the data).

How do we collect your Personal Data and how long are they kept?

Collection of your Personal Data

We collect your Personal Data – without being exhaustive – in the following cases:

  • when you enter into an (employment) agreement with us;
  • when you fill in the forms provided on the Website;
  • when you register through the Website;
  • when you place an online order through the Website;
  • when you call, email or otherwise correspond with us other than via the Website;
  • when you use the programs and search tools provided on the Website;
  • when you apply for a position at WÜRTH BELUX.

We avoid collecting Personal Data that are not relevant for the purposes set out in Article 3.

Retention of your data

The Personal Data are retained and processed by us for a period necessary in view of the purposes of the processing.

Customer data and data of suppliers or subcontractors will in any case be removed from our systems after a period of 7 (seven) years following termination of the agreement, except in the event of an ongoing dispute for which the Personal Data are still necessary.

Personal Data of staff are deleted immediately and at the latest 5 (five) years after termination of the employment relationship, except with regard to the Personal Data that we must retain longer on the basis of specific legislation or in the event of an ongoing dispute for which the Personal Data are still necessary.

Personal Data of applicants are deleted after the relevant vacancy has been filled, at the latest 1 (one) month after the end of the application procedure, or after a period of 1 (one) year after consent was obtained to inform applicants about future job opportunities.

Other data are not retained for longer than a period of 2 (two) years after the last time meaningful contact took place with you, except in the event of explicit consent to retain these data for longer.

Transfer of Personal Data

We will not transfer Personal Data to third parties located outside the European Economic Area. An exception may apply to subcontractors or staff members (i) established in a country recognised by the European Commission or the Minister of Justice as providing an adequate level of protection for the processing of Personal Data, or (ii) who store the Personal Data in accordance with the Standard Contractual Clauses of the European Commission and thereby provide an adequate level of security for the processing of Personal Data.

Furthermore, we will not transfer Personal Data to other parties located within the European Economic Area without your consent, unless:

  • the transfer is necessary to enable employees, agents or subcontractors to provide a service or perform a task on our behalf that is necessary for the performance of the agreement we have with you or in the context of our legitimate interest (including but not limited to providing marketing support, conducting market research or providing customer service);
  • this is legally required.

Any transfer of Personal Data to a recipient as listed above is in accordance with the provisions of the General Data Protection Regulation 2016/679.

We ensure that measures are taken so that recipients cannot use the Personal Data for purposes other than those exhaustively listed in Article 3 and that recipients have implemented sufficient technical and organisational measures to protect these data.

In order to guarantee the security of the Personal Data, we will always conclude a data processing agreement with the above-mentioned recipients of the Personal Data.

We will take all necessary precautions to ensure that employees and staff members who have access to the Personal Data process them exclusively in accordance with this privacy statement and the legal obligations under the General Data Protection Regulation 2016/679.

Rights of the data subject

Under both Belgian and European legislation on the protection of Personal Data, you have the rights described below. If you wish to exercise these rights, you must send us a written request to privacy@wurth.be.

We will inform you within a period of 1 (one) month after receipt of the request about the action to be taken. This period may be extended by a maximum of 2 (two) months in the case of a complex request, in which case we will inform you within 1 (one) month after the original request of the reasons for this delay. If we decide not to act on your request, we will inform you within 1 (one) month after receipt of the request why the request will not be acted upon.

The right of access to Personal Data

You have the right to instruct us to provide all Personal Data that we hold about you and to request a free copy thereof, provided that the rights of other data subjects are not adversely affected. If you request additional copies, we will charge a reasonable fee equal to the administrative cost of making these copies.

The right to rectification of Personal Data

We kindly ask you to ensure that the Personal Data in our database are as accurate and complete as possible. If you believe that the data provided to us are incorrect or incomplete, you are requested to notify us as described above. We will then correct or supplement your Personal Data as soon as possible.

The right to erase Personal Data

You have the right to have your Personal Data erased without undue delay in the following cases:

  • if it is no longer necessary to retain the Personal Data in relation to the purposes for which they were collected or otherwise processed;
  • if it is legally required;
  • if the Personal Data were obtained when you were still a minor;
  • if the Personal Data were obtained without your explicit consent;
  • if you withdraw your consent to the consent-based processing of the Personal Data;

However, there are certain general exclusions to the right to erasure. Those general exclusions include cases where processing is necessary:

  • for compliance with a legal obligation; or
  • for the establishment, exercise or defence of legal claims.

The right to restrict the processing of Personal Data

In the following cases, you have the right to restrict the processing of your Personal Data:

  • to contest the accuracy of your Personal Data;
  • where the processing is unlawful, but you do not want the Personal Data to be erased; or
  • if you object to the processing of your Personal Data, pending the verification of that objection.

If processing is restricted on this basis, we may continue to store your Personal Data. However, we will only process the data with your explicit consent, for the establishment, exercise or defence of legal claims, for the protection of the rights of another natural or legal person or for reasons of important public interest.

The right to object

You have the right to object to our processing of your Personal Data in the following cases:

  • if we process your Personal Data for direct marketing purposes (including profiling for these purposes) on the basis of our legitimate interest;
  • because of your specific situation (your particular personal circumstances).

The right to data transfer (“data portability”)

If you wish to exercise your right to data portability, we will transfer the Personal Data in a structured, commonly used and machine-readable format to a data controller of your choice.

The right to withdraw consent

To the extent that the legal basis for our processing of your Personal Data is your consent, you have the right to withdraw that consent at any time. However, this withdrawal does not affect the lawfulness of the processing that took place before the withdrawal.

The right to lodge a complaint with a supervisory authority

You may contact the Data Protection Authority at any time by sending an email to contact@apd-gba.be or by sending a written request to the Data Protection Authority, located at 1000 Brussels (Belgium), Drukpersstraat 35. You have the possibility to bring an action before the competent court.

Reference to third parties

The Website may contain links to other websites that are not managed by us. Although we make every effort to ensure that the references lead only to websites with corresponding security and confidentiality standards, we are in no event responsible for the protection and confidentiality of Personal Data, including the data you provide on other websites, once you have left the Website.

We emphasise that you should proceed carefully and always consult the privacy statement applicable to the website concerned before providing Personal Data on other websites.

Amendments

We have the right to amend this privacy statement at any time by publishing a new version on our Website.

We recommend that you consult the Website regularly in order to verify whether you agree with any changes to this privacy statement.

In any event, you will be informed by email of any amendment to this privacy statement insofar as we have your email address.

WÜRTH BELUX uses “cookies” whenever you use the Website. A “cookie” is information sent via the server to your device and stored on the device’s hard drive.
